Public consultation ends

The Immigration Advisers Authority is one step closer to opening for business, thanks to the completion of its public consultation process around the proposed competency standards and code of conduct.  From May 2008, the Authority will administer licensing for Immigration Advisers, both in New Zealand and off-shore.
 
Registrar Barry Smedts says he’s pleased with the quality of the submissions received. 

“I want to thank everyone who has taken the time to have their say about the proposed standards and code.  Getting these elements right is at the heart of a quality licensing process, and I will consider all feedback as part of the decision-making process.”

Barry Smedts also says he’s looking forward to the Authority’s opening next May.

“Licensing Immigration Advisers is going to work well for everyone. Legitimate Advisers will be supported to give their clients sound advice and professional service through the recognition of their work as a regulated profession.

"Complaints against Immigration Advisers may be referred to the new independent Complaints and Disciplinary Tribunal for determination upon completion of investigation by the Immigration Advisers Authority. Breaches of the code of conduct will incur stiff penalties. This gives migrants who have been unfairly treated an avenue for redress, as well as protecting the reputation of those Advisers who work honestly and fairly within the bounds of the law.”

Once the Registrar has considered the submissions, he will submit the competency standards and code of conduct to the Minister of Immigration for final approval.  This is currently scheduled for early 2008.  Documents will be made publicly available once this process is complete.

Applications to become a licensed Immigration Adviser can be made from 4 May 2008.  People providing immigration advice in New Zealand will have to be licensed from 4 May 2009.  For offshore Advisers giving advice on New Zealand immigration matters, mandatory licensing comes into effect from 4 May 2010.
