Under the Immigration Advisers Licensing Act, it is an offence to give immigration advice about New Zealand when not licensed or exempt.
The Immigration Advisers Authority takes enforcement action, including prosecutions, against people who are found to be breaking the law.
A migrant who consults an unlicensed and not exempt person is not committing an offence, however Immigration New Zealand may refuse to accept their immigration application.
A person may be charged with an offence under the Immigration Advisers Licensing Act whether or not the offence or any part of it occurred within New Zealand.
If you know of anybody who may be giving immigration advice while neither licensed nor exempt, please contact us.
