I am based in New Zealand and provide advice about New Zealand immigration matters. Do I require a licence?

Yes.  You require a licence unless you are exempt.

I am based offshore and provide advice about New Zealand immigration matters.  Do I require a licence?

Yes.  You must be licensed by 4 May 2010 at the latest.  This means that you should be thinking about preparing and lodging your application now, because the Registrar requires detailed evidence from you in order to grant a licence.

If you are outside of New Zealand when you lodge your application for a licence, then you will pay the offshore application fee of  NZ$791.11  (the onshore fee of NZ$890.00, less GST) and the offshore levy of $NZ982.22 (the onshore levy of NZ$1105.00, less GST).

I am based offshore and provide advice about New Zealand immigration matters.  All my clients are in New Zealand and I provide advice to them by email/phone.  Do I require a licence?

If you are outside of New Zealand when you lodge your application for a licence then you will pay the offshore application fee of  NZ$791.11  (the onshore fee of NZ$890.00, less GST) and the offshore levy of NZ$982.22 (the onshore levy of NZ$1105.00, less GST).

I am currently in New Zealand but have been here for less than 183 days and am therefore “not ordinarily resident”.  Do I require a licence?

Yes.  If you are currently in New Zealand and you are providing immigration advice you require a licence now, unless you are exempt.  This means that you must not provide immigration advice or you will risk prosecution.

If you are physically present in New Zealand on the date you lodge your application for a licence you will pay the onshore application fee of NZ$890.00 incl GST and levy of NZ$1105.00 incl GST.

I am “ordinarily resident” in New Zealand but am currently overseas.  Do I require a licence?

Yes.  If you are ordinarily resident in New Zealand but are currently overseas and you are providing immigration advice you require a licence now, unless you are exempt.  This means that you must not provide immigration advice or you will risk prosecution. 

If you are ordinarily resident in New Zealand when you lodge your application for a licence (even if you are overseas on that date), you will pay the onshore application fee of NZ$890.00 incl GST  and onshore levy of  NZ$1105.00 incl GST.
